This is an interesting question and can answer this based on a local incident. Laws are always changing and being revised, sometimes due to political agendas or due to personal interest. Massachusetts has typically had strict laws regarding OUI/DUI, but there were some substantial changes made around 2003. In 2003 Melanie Powell was killed while crossing the street while on her way to a birthday party by a repeat drunk driver. This incident cause concern due to the high number of repeat OUI offenses in MA. Melanie’s Law pushed for stiffer drunk driving laws, specifically for repeat offenders. Melanie’s Law effected drunk driving cases where the breathalyzer was utilized as well those that were not used, or an offender refused to provide a breath sample. Melanie’s Law now allows for previous OUI cases to be brought up in court and to be used against those being charged for OUI. There was also a change that doubled the mandatory minimum sentences for those convicted of OUI where death resulted. They made it more difficult for repeat offenders to regain driving privileges and now requires an interlock device to be installed on their vehicle and can only operate a vehicle that is equipped with such a device. Repeat offenders also have immediate loss of license for a significant period, or lifelong license suspension. This legislation made huge changes in policy and laws for any OUI conviction.
